Magyarország nyilatkozata a Komstroy ítéletnek való tagállami megfelelésről
Az Európai Unió Bíróságának 2021. szeptember 2-i C-741/19. sz. République de Moldavie v Komstroy ügyben hozott ítéletében kimondta, hogy az Energia Charta Egyezmény eddig intra-EU viszonylatban is alkalmazott vitarendezési cikke uniós tagállamok között nem alkalmazható.
Az Európai Unió és tagállamai ezáltal 2024. június 26-án politikai deklarációban fejezték ki álláspontjukat az Energia Charta Egyezmény vitarendezési cikkének uniós alkalmazhatatlansága vonatkozásában. Magyarország a többi tagállammal egyidőben, de a nemzetközi joggal való összhang biztosítása érdekében egy különálló politikai deklarációt tett a Bíróság Komstroy ítéletének végrehajtásáról.

Statement by Hungary on its implementation of the Komstroy judgment
In its judgment of 2 September 2021 in case C-741/19 République de Moldavie v Komstroy, the Court of Justice of the European Union ruled that the dispute settlement article of the Energy Charter Treaty, which has been applied in intra-EU relations, is not applicable between EU Member States. On 26 June 2024, the European Union and its Member States thus expressed their position on the inapplicability of the dispute settlement article of the Energy Charter Treaty to the EU in a political declaration. Hungary made a separate political declaration on the implementation of the Komstroy judgment at the same time as the other Member States, but in order to ensure consistency with international law.
